Montana Mediators Institute offers educational programs from mediation to education. We offer a series of fully accredited mediation trainings along with advanced workshops on topics of interest to those in the conflict resolution and communication field. "Negotiators are made, not born."

Leave the "touchy-feely" and "war stories" at the door. It is amazing how many aspects of negotiation have been studied and how much is proven and known about effective negotiation and conflict resolution processes as exampled by the Harvard Pro-gram on Negotiation or Fisher School of Business at the Ohio State University. Today over a dozen ABA law schools offer an LLM in ADR.

We negotiate to keep control of the outcome, resolve a dispute, or create some-thing requiring the assent of the other. You need to understand the game, predict sequence of negotiation from strategy and tactics through closure. You need to handle the difficult conversations, protecting yourself against the "barracuda" or just the myriad negotiations that occupy your day. While today most Fortune 500 companies favor a collaborative style instead of a competitive one, a professional negotiator needs to be competent in both. You need to master the competitive game; it is played frequently, so it is important to understand how it works. Most importantly, most negotiations are a combination of both and that is what we cover in this workshop.

MEDIATING THE CIVIL CASE:

Many law practitioners hold themselves out as mediators, relying solely on their own background and expertise yet no formal background in the "process". As the use of mediation explodes in popularity, assuring the quality of mediation services has be-come an increasingly viable challenge.

This workshop focuses on two basic models: evaluative and facilitative. While the former lends itself to the one time or episodic situation, the latter focuses on cases involving a continuing relationship. The best practitioner is able to work with both as the needs of the parties present themselves. The facilitative mediator does not make substantive recommendations, give advice on outcomes, or predict what a court will do.

Evaluative mediation is a process modeled on the settlement conference. An evaluative mediator assists the parties in reaching resolution by pointing out the weaknesses of their cases, or strengths of the opponent. An evaluative mediator might make formal or informal recommendations to the parties as to the outcome of the issues. Evaluative mediators meet, most often, in caucus with the parties and their attorneys. This workshop studies both models.

FAMILY MEDIATION:

This interdisciplinary workshop is an advanced mediation skills course coupled with the basics of divorce mediation practice. While the mediation of family disputes can be the basis of a successful practice, it is also one of the most demanding applications of media-tion principles. Federal agencies require a course such as this for mediating their cases recognizing the cross over between family and corporate disputes.

Concentration on power balancing, gender and other cultural differences, building trust in the mediator and the process are all mainstays of the successful practitioner. The Divorce mediator is well educated in needs of the children in divorce and a guide to the parents in creating a parenting plan that really is "in the child's best interest". Understanding the psychological needs of the parents and the children as the go through the maze of the divorce and anticipating future problems and approaches to resolution. This course in conjunction with the Mediating the Civil case is the only class nationally certified in a six state area by the Association for Conflict Resolution. ( ACRnet.org)
